Privacy Policy

Plain-language summary: Winsighter is a document preparation software company, not a law firm. We collect only what is necessary to prepare your court forms and deliver your order. We do not sell your data. Estate information you share is used only to fulfill your order. For our Attorney-Review tier, your document packet is shared with an independent licensed attorney solely for the purpose of your review call. You have rights to access, correct, and delete the information we hold about you.

What This Policy Covers

Winsighter, LLC ("Winsighter," "we," "us," or "our") provides self-service document preparation software for California probate and estate matters. We are not a law firm and we do not provide legal advice. In certain circumstances, we may facilitate access to independent, third-party licensed attorneys who are not employees of Winsighter. This Privacy Policy explains what personal information we collect, how we use it, and your choices regarding that information when you use our website at winsighter.com (the "Site") and our document preparation software (collectively, the "Service"). This policy does not cover: • Personal information collected by third-party websites or services that you reach by clicking links on our Site. Please refer to those sites' own privacy policies. • Information collected in connection with employment or job applicant activities. Point of Collection: This Privacy Policy applies to information collected through our anonymous Estate Screener and intake questionnaire from the first moment you enter any data, whether or not you have created an account. The screener and intake are covered by this policy from first data entry, and a link to this policy is displayed on the screener page for your review before or at the point of collection. By using the Service, you agree to the data practices described in this Privacy Policy.

1. Information We Collect

1a. Information You Provide Directly

When you use our screener, intake questionnaire, or contact us for support, we may collect: • Contact information such as your name and email address • Information about the decedent's estate — including asset types, approximate values, property details, and beneficiary relationships — necessary to generate the correct court forms and filing instructions • Payment information. Payment card data is collected and processed directly by Stripe, our third-party payment processor. Winsighter does not store your full card number, expiration date, or CVV. • Messages and attachments you send us via email or support requests We collect only the information necessary to provide the Service you requested.

1b. Information Collected Automatically

When you visit our Site, we automatically collect certain technical and usage data, including: • Your IP address and approximate location (city/region level only) • Browser type, version, and operating system • Pages you visit, time spent on each page, and referring URL • Device type and screen resolution • Anonymized session identifiers We use this data to understand how visitors navigate our Site, diagnose errors, improve the Service, and measure the effectiveness of our content. We do not use this data to build individual advertising profiles or sell it to data brokers.

1c. Cookies and Browser Storage

We use a limited and purposeful set of cookies and browser storage technologies: Strictly Necessary: Session cookies that allow the screener questionnaire and checkout flow to function correctly. These are deleted automatically when you close your browser. Functional: "sessionStorage" values used to remember in-session preferences, such as whether you dismissed an informational banner. This data is stored only in your browser and is never transmitted to our servers. Analytics: We may use analytics tools (such as Google Analytics with IP anonymization enabled) that set persistent cookies to help us understand aggregate visit patterns. You can opt out via your browser's privacy settings, by enabling a Do Not Track signal, or by using the Google Analytics Opt-Out browser extension. We do not use advertising cookies, retargeting pixels, or cross-site tracking technologies.

1d. Automated Processing and Decision-Making

We use automated processing, including artificial intelligence, to assist in generating your document packet and to flag potential issues for human review. Specifically: • Our AI-assisted document drafting uses information you provide to populate court forms appropriate for your estate matter. The output is always reviewed by you before submission. • Our AI case-review feature may identify potential data inconsistencies, missing information, or items warranting attention. Any such flags are presented to you and/or an assigned LDA for human review — no automated decision has final legal effect without human oversight. • Eligibility determinations (e.g., whether your estate qualifies for a given summary proceeding) are made by our rules engine based on the information you enter. These determinations are informational only; you retain the right to contest any automated output by contacting support@winsighter.com. You have the right to request human review of any automated output that materially affects your order. To exercise this right, contact support@winsighter.com.

2. How We Use Your Information

We use the information we collect for the following business purposes: • To provide the Service: generate your document packet, deliver it to you, and provide filing instructions • To process payments securely through our payment provider • To send you transactional communications — order confirmations, document delivery notifications, and support responses • To improve the Site and Service based on aggregate, anonymized usage trends • To detect and prevent fraud, abuse, or unauthorized use of the Service • To comply with applicable legal obligations, court orders, or regulatory requirements We will not send you marketing emails unless you have explicitly opted in. You may opt out of marketing communications at any time by clicking "Unsubscribe" in any such email or by contacting us at privacy@winsighter.com.

3. How We Share Your Information

We do not sell your personal information. We do not share it with third parties for their own marketing purposes. We share your information only in the following, limited circumstances: Service Providers: We work with trusted third-party vendors who process data on our behalf under contractual obligations. Current key service providers include: • Stripe (payment processing) — payment card data flows directly to Stripe and is governed by Stripe's Privacy Policy • Google Firebase / Google Cloud (hosting and database infrastructure) — data is stored on servers located in the United States • Anthropic, Inc. (AI subprocessor) — we use Anthropic's Claude models to power document drafting and case review. Your data is processed solely to provide the Service and is not used to train models. • Email delivery providers — used to deliver your documents and order confirmations • California-registered Legal Document Assistants (LDAs) — where you purchase our Full-Service Filing tier, the independent LDA assigned to your case processes your case data solely to prepare your document packet, under a written data protection and confidentiality clause in the LDA's agreement with Winsighter Attorney-Review Partners: If you purchase our Attorney-Review tier, the minimum necessary information from your order (your prepared document packet and the relevant estate details you provided) will be shared with the independent, CA-licensed attorney assigned to conduct your document review call. That attorney is an independent contractor, not a Winsighter employee, and is bound by their own professional obligations of confidentiality. Legal Requirements: We may disclose information if required by law, subpoena, court order, or regulatory process, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Winsighter, our users, or the public. Business Transfers: If Winsighter undergoes a merger, acquisition, or sale of substantially all its assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a materially different privacy policy.

4. Sensitive Personal Information and Estate Data

Under the California Privacy Rights Act (CPRA), certain categories of information we collect qualify as "Sensitive Personal Information" (SPI). The estate-related information you share — including asset valuations, beneficiary names, family relationships, property details, and identity documents — falls within CPRA's SPI classification. We apply heightened protections to this data: • We use estate information and SPI solely to prepare the document packet and filing instructions for your specific order • We do not use SPI for advertising, data brokering, profiling, or any purpose unrelated to fulfilling your order • We do not disclose SPI to any third party not directly involved in delivering your order • Where attorney review is included, estate information is disclosed to the reviewing attorney only to the extent necessary to complete the review, and is subject to attorney confidentiality obligations • Court filing fees collected on your behalf are held in trust and passed through to the applicable court. We do not retain court fees as revenue. Right to Limit Use of Sensitive Personal Information: California residents have the right to direct us to limit the use and disclosure of SPI to that which is necessary to perform the services you requested. To exercise this right, contact privacy@winsighter.com with the subject line "Limit SPI Use." Because we already limit SPI use to service delivery, exercising this right will not affect your ability to receive the Service.

5. How Long We Keep Your Information

We retain your information for the following periods: • Order records and prepared documents: 7 years following completion of your order, consistent with California record-keeping requirements for estate and legal services • Identity and supporting documents (e.g., death certificates, driver's licenses, property deeds, and similar sensitive records you upload): retained only for the duration of the active case and any defined post-completion period needed for support, compliance, or legal obligations, after which they are securely deleted or de-identified • Payment transaction records: 7 years, as required under tax reporting laws. Full card data is retained by Stripe per their own retention policy — we never hold it • Customer support communications: 3 years • Analytics data: up to 14 months (aggregated and anonymized) • Session and browser storage data: deleted automatically when you close your browser tab After the applicable retention period has passed, we securely delete or irreversibly anonymize your information.

6. How We Protect Your Information

We implement industry-standard technical and organizational measures to protect your information: • All data transmitted between your browser and our servers is encrypted in transit using TLS 1.2 or higher • Data stored in our systems is encrypted at rest using AES-256 or equivalent standards • Access to customer data is limited to authorized personnel with a documented need to access it • Payment processing is handled entirely by Stripe, a PCI-DSS Level 1 certified provider; we never handle raw card data • We conduct periodic security reviews and update our controls accordingly No method of internet transmission or electronic storage is completely secure. If you suspect a security incident involving your information, please contact us immediately at privacy@winsighter.com.

7. Your Privacy Rights (California Residents)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA): Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you in the past 12 months, the purposes for which it was collected, and any third parties with whom it was shared. Right to Delete: You may request deletion of personal information we hold about you, subject to certain exceptions (for example, where we are legally required to retain records). Right to Correct: You may request that we correct inaccurate personal information we hold about you. Right to Opt Out of Sale or Sharing: We do not sell personal information, and we do not share it with third parties for cross-context behavioral advertising. Right to Limit Use of Sensitive Personal Information (SPI): You may direct us to limit our use and disclosure of SPI to the purpose for which you provided it. See §4 above for details. Right to Non-Discrimination: We will not discriminate against you — by denying services, charging different prices, or providing a lesser quality of service — as a result of your exercise of any privacy right. To submit a privacy rights request, email privacy@winsighter.com with the subject line "Privacy Rights Request." We will verify your identity and respond within 45 days. Where we cannot fulfill a request (for example, due to a legal obligation to retain records), we will explain the reason.

8. Privacy Rights for Residents of Other States

Residents of the following states have privacy rights that are substantially similar to California's CCPA/CPRA rights described in §7 above. We extend the same core rights — Right to Know, Right to Delete, Right to Correct, Right to Opt Out of Sale, and Right to Non-Discrimination — to residents of: • Virginia (Consumer Data Protection Act / CDPA) • Colorado (Colorado Privacy Act / CPA) • Connecticut (Connecticut Data Privacy Act / CTDPA) • Utah (Utah Consumer Privacy Act / UCPA) • Texas (Texas Data Privacy and Security Act / TDPSA) • Oregon (Oregon Consumer Privacy Act / OCPA) Residents of these states may submit requests by emailing privacy@winsighter.com with the subject line "Privacy Rights Request." We will respond within the timeframe required by your state's law (generally 45–60 days, with one permitted extension). Where your state's law provides appeal rights for denied requests, we will include instructions for submitting an appeal in our response.

9. Children's Privacy

Our Service is designed for adults dealing with estate matters and is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a child has provided us with personal information without appropriate consent, please contact us at privacy@winsighter.com and we will promptly delete it.

11. Changes to This Policy

We may update this Privacy Policy to reflect changes in our Services, legal requirements, or data practices. When we make material changes, we will: • Update the "Last Updated" date at the top of this page • Post a notice on the Site homepage for at least 30 days before changes take effect • Where practicable, notify users by email Your continued use of the Service after the effective date of a revised policy constitutes your acceptance of the updated terms. We recommend reviewing this page periodically.
